Since CBD is derived from cannabis, you've probably wondered more than once whether CBD can be detected in a saliva test if you're stopped by law enforcement while driving. What is it? What are the risks? In this article, I give you the lowdown.

Why can CBD be detected by saliva testing?

Let's get back to basics first: CBD at Irelandis not considered a narcotic! In fact, the only molecule classified as a drug is THC, another cannabinoid found in hemp. THC is also found in all CBD-based products that are said to be full spectrum. In other words, these products contain trace amounts of all the cannabinoids found in hemp.

As a reminder, for a cannabis-based product to be legal in Ireland, it must contain less than 0.3% THC. If it doesn't, it's considered a drug - and you're liable to penalties!

What about CBD and saliva testing? In fact, CBD is not one of the substances tested in this kind of procedure. However, saliva tests do look for THC, so it's this molecule that can be detected in the event of a control.

You should also know that if you test positive during the saliva test, you can appeal and ask for a blood test to be taken within 5 days of the saliva test.

What are the consequences if CBD is detected in a saliva test?

As I explained earlier, CBD will not be detected by the saliva test. However, if you've been using CBD-based products and their THC levels turn out to be too high, or out of compliance, or because of the cumulative effect of THC for a heavy daily user, you could end up with a positive test. In this case, you're considered to be under the influence of a narcotic.

In this case, you risk several penalties:

  • Up to 4,500 euros fine;
  • Up to 2 years in prison;
  • Vehicle immobilization possible without impounding;
  • 6 points deducted from the licence, or full withdrawal of the licence if it was probationary.

Of course, these penalties are even more severe if the substance was combined with alcohol, and can result in 3 years' imprisonment, a deduction of 8 points and a fine of up to 9,000 euros.

How to avoid a positive saliva test?

Firstly, it's essential to buy from a store that certifies that its products comply with the legal THC level of less than 0.3%. It's also preferable to opt for a brand of CBD products that has them tested by independent laboratories.

Secondly, you can always choose to buy broad spectrum CBD products, which are completely THC-free. This type of product remains high quality and avoids any risk of a positive saliva test.

Otherwise, in terms of precautions, don't forget to drink water to drain the molecules. Otherwise, wait before driving. THC is only detectable with saliva tests for 6 to 8 hours after consumption, hence my frequent recommendations to consume CBD in the evening before bedtime.
